Motor or cycling personal injury claims

If you are injured in a road traffic accident and the incident was not your fault, you can usually make a successful claim for compensation for any injuries you have sustained. This applies even if you were a passenger or a bystander when you were injured.

Making a claim for compensation after an accident

You generally have three years from the date of an accident to commence proceedings. Even if you believe that you were partly to blame, you may be entitled to compensation if another party was also negligent.

If you instruct us to act on your behalf in respect of your compensation claim, we’ll start gathering evidence straight away. We will arrange for you to have medical assessments to start evaluating the extent of your injuries and your long-term prognosis.

We will file your claim at court and notify the insurance company of the at-fault party. If they admit liability for the accident, we will negotiate robustly with them to agree on a sum to compensate you.

If they do not admit liability, we will put together a strong case on your behalf to try and prove that their client was at fault.

How much compensation am I likely to receive for the accident?

The compensation you receive will depend on the severity of your injuries and how they are likely to affect you in the future. If your injuries are fairly serious, you may need to have several medical appointments over a period of months or longer to assess your ongoing needs and difficulties.
Compensation is divided into two categories:

General damages

General damages are to compensate you for the loss of quality of life you have sustained, to include the pain and suffering you have experienced because of the accident and losses such as your inability to take part in activities.

Special damages

Special damages are more specific and can be more easily calculated. They are financial losses and expenses resulting from the accident such as loss of earnings and future earnings, expenses for treatment and medical care, the cost of ongoing assistance and any travel expenses directly related to the accident, such as going to hospital appointments.
